Terms of Service

Last updated July 2026. By accessing or using The People Pocket ("the Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

2. Decision authority rests with you

You (the customer, employer, or authorized user) are the decision-maker on every employment action. The Service provides analysis, drafts, scripts, and options. Selecting, adapting, communicating, and implementing any action, including discipline, accommodation, leave, investigation, separation, or restructuring, rests solely with you and your organization. The Service does not act as an employer, agent, fiduciary, joint employer, or co-decision-maker.

3. AI limitations

Output is generated by large language models and may contain errors, omissions, outdated information, or statements that are inconsistent with the facts of your situation or with current federal, state, or local law. The Service cannot verify facts you have not provided. You are responsible for reviewing all output before acting on it and for confirming jurisdiction-specific requirements.

4. Litigation discovery notice

Conversations, drafts, uploads, case files, and other records created in the Service are business records of your organization. In the event of a charge, claim, investigation, arbitration, or lawsuit, these records may be discoverable and producible on the same basis as any other business record, including notes, emails, or files that would exist from an internal HR business partner or third-party HR consultant.

You should treat entries in the Service accordingly: keep them factual, avoid speculation about protected class or motive, and follow your organization's record-retention, litigation-hold, and preservation obligations. When you become aware of a reasonably anticipated claim, take standard preservation steps for content in the Service the same way you would for email, Slack, or an HRIS.

5. Confidentiality & privilege

Communications with the Service are not privileged. The Service is not your lawyer and cannot extend attorney-client privilege or work-product protection. If a matter is or may become privileged, route the sensitive analysis through counsel, do not rely on the Service to preserve privilege.

7. Customer data & your license to us

As between you and The People Pocket, you own the content, situations, uploads, drafts, and notes you submit through the Service ("Customer Data"). You grant The People Pocket a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and modify Customer Data solely to provide, secure, and improve the Service for you and to comply with law. We will not use identifiable Customer Data to train third-party foundation models, and our AI inference subprocessors are contractually barred from doing so.

You represent and warrant that you have all rights and any required consents to submit Customer Data to the Service (including personal information about your employees, applicants, and contractors) and that your submission and our processing on your behalf will not violate law or any third-party right.

8. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless The People Pocket, its affiliates, officers, directors, employees, contractors, and licensors from and against any and all claims, demands, causes of action, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) any employment decision, action, or inaction you take or fail to take, whether or not informed by output from the Service; (c) your violation of these Terms; (d) your violation of any applicable law, regulation, or third-party right; or (e) content you submit to the Service.

9. Disclaimer of warranties & limitation of liability

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

To the fullest extent permitted by law, The People Pocket and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service, even if advised of the possibility of such damages. Aggregate liability for any and all claims arising out of or relating to the Service is limited to the greater of (i) the fees you paid to The People Pocket for the Service in the twelve (12) months preceding the event giving rise to the claim, or (ii) US $100. These limitations apply regardless of the theory of liability and even if a limited remedy fails of its essential purpose.

10. Acceptable use

You will not, and will not permit any user of your account to: (a) use the Service to violate law or any third-party right; (b) harass, threaten, or defame any person; (c) upload content you do not have the right to share, or content that is malicious, deceptive, or unlawful; (d) reverse-engineer, decompile, scrape, or attempt to circumvent access controls, rate limits, or usage caps; (e) use the Service to build a competing product or benchmark for a competing product; (f) generate content intended to mislead an employee about their legal rights; or (g) submit personal information of a resident of a jurisdiction whose laws prohibit its transfer to the United States.

11. Account, subscription & billing

You are responsible for maintaining the confidentiality of your credentials and for all activity on your account. Paid subscriptions are billed in advance on a monthly or annual cycle and automatically renew for successive terms unless cancelled before the renewal date. Fees are non-refundable except where required by law. Subscription changes take effect at the start of the next billing cycle. You may cancel at any time from your account; access continues through the end of the current paid period. We may adjust pricing on 30 days' notice for the next renewal term.

12. Suspension & termination

We may suspend or terminate your access to the Service if you materially breach these Terms, if your account presents a security or legal risk, or if payment fails and is not cured within 15 days of notice. You may terminate at any time by cancelling your subscription and deleting your account. Sections that by their nature should survive termination, including Customer Data license, indemnification, disclaimers, limitation of liability, governing law, and any accrued payment obligations, will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois for any action not subject to arbitration. Each party waives any right to a jury trial to the fullest extent permitted by law. Any claim must be brought within one (1) year after it accrues or be permanently barred. Nothing in this section restricts either party from seeking injunctive relief for intellectual property misuse or breach of confidentiality in any court of competent jurisdiction.

14. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by in-product notice or email to the account administrator. Continued use of the Service after changes take effect constitutes acceptance.
